How No Fault Insurance Affects You

 

No fault insurance is often misunderstood, or a completely alien concept to many people. Because Florida is one of only 12 states that currently has no fault insurance, it is to your benefit to understand what it is.

Generally speaking, no fault insurance is a type of auto insurance wherein you are not only required to carry insurance for your own protection, but also have a limitation placed on how much you may sue another driver for damages if you are involved in an accident. It is designed as such to cut down on the amount of fraud the state has seen in the past. However, this leads to a lot of ambiguity placed in the system. On the one hand, no fault insurance guarantees that you are covered for immediate medical treatment if you are injured in an accident, as well as to provide quick payment for those injuries. It is also intended to reduce any fees, such as legal or administrative, associated with insurance claims.

On the other hand, you may find that negligent or reckless drivers who have injured you or a loved on are not punished enough due to caps on damage claims. If you are severely injured, the payment may not be enough to cover all expenses. No fault premiums are also more expensive than traditional or standard auto insurance premiums.
