The family of a truck driver who was killed this week when his vehicle
rolled over him potentially may bring a wrongful death claim under Florida’s
Media reports write that Deivys Viamonte of Hialeah, Florida, was transporting
vehicles in his truck on I-75, when he pulled over at a rest stop to make
adjustments to his vehicle’s brakes.
Mr. Viamonte crawled under the truck to make the adjustments, but inexplicably,
the truck began to roll, crushing and killing him at the scene.
The tragic and unfortunate accident occurred just outside Lake City, Florida.
The potential for the Viamonte family to make a wrongful death claim under
While the facts and the circumstances which lead to Mr. Viamonte’s
death are scant pending a comprehensive report by Florida Highway Patrol,
what we do know seems to point to some sort of failure of the truck’s
mechanics to stay in place.
There may have been a malfunction of the complex braking systems and mechanics
within the tractor. If malfunction turns out to be a viable cause of his
death, the surviving family members of Mr. Viamonte may have rights under
Florida’s Wrongful Death laws to pursue the defendants responsible for the failures.
Potential defendants could include the manufacturer of the tractor-trailer,
the commercial liability insurer, Mr. Viamonte’s employer, the owner
of the tractor-trailer, or perhaps any mechanics or shops who have serviced
the truck recently.
Any compensation recovered for the surviving family by a
personal injury attorney or law firm may be used to pay for funeral and burial processions, economic
and emotional damages, lost future earnings and wages, and more.
While attorneys cannot bring a loved one back, or reverse the severe psychological
trauma and grief surviving family members are experiencing, we may be
able to secure compensation for the family that will make life a little
easier in the years to come.
