Truck Accidents in Florida
On Palm Beach roadways, the risk can be deadly. I-95 is one of the most dangerous Palm Beach roadways. Although the speed limit is posted at 55, many drivers routinely drive at speeds exceeding 80 miles an hour.
How Truck Accident Claims Differ From Car Accident Claims
Truck accidents prove even more challenging than car accidents, mainly because commercial entities are involved, making it more difficult to determine who is at fault. Additionally, truck accident injuries are generally far more serious, resulting in greater numbers of fatalities.
At the West Palm Beach personal injury law firm of Craig Goldenfarb, we offer over a decade of skill and experience to analyze and pursue your truck accident claim vigorously, thoroughly compensating you within the full spectrum of the law. We’ll confidently represent you against the big insurance companies, fighting for your rights against negligent drivers to obtain compensation for:
- Personal injury
- Lost wages
- Medical bills
- Damage to your vehicle
- Pain and suffering
If you’re injured in a truck accident in South Florida, including Palm Springs, Stuart, and Fort Pierce, contact Craig Goldenfarb before you call your insurance company. We offer a free initial consultation and case evaluation, along with compassionate assistance to help you deal with the physical, emotional and financial aspects of your claim.

Defective Roadways – Who is Responsible?
If you’ve ever driven over a pothole, you may wonder when it will be fixed, and whose job that is. Because the roads are the responsibility of different government agencies, it is up to them to fix them. However, you may notice that sometimes the potholes seem to take a long time to be fixed, especially if you drive over the same one every day. Now, imagine traveling down the road and hitting a pothole unexpectedly. If you are traveling at a high rate of speed, hitting a pothole can be dangerous and lead to an accident causing injury or death. Perhaps this pothole is new and the agency responsible for fixing it just didn’t know about it.
However, there are incidences of a record having been created where those responsible for fixing it were already aware and did nothing about it. Their failure or negligence to fix the road has now caused an accident where an individual has been injured or killed. Sometimes a defect in a roadway like this isn’t fixed until the agency responsible is forced to pay a penalty in court. But why should anyone have to go through something like this if a defect as innocuous as a pothole was already known about?
While this scenario uses potholes as an example, there are other defects that are just as serious. They include:
- Excessive oil and/or gravel
- Failure to post signals or warning signs
- Malfunctioning warning signs or signals
- Insufficient or inadequate notification of shoulder changes
- Shoulder drop-offs
- Insufficient or inadequate notification of construction zones, hazardous weather conditions, or merging traffic
Any of these defects has the potential to cause an accident that result in injury or death. If you believe that your accident was the result of a defect that could or should have been known about, please contact us for a case evaluation. You need to be aware that the problem, once known about, may be quickly remedied and any evidence removed. Act quickly so that you can receive the compensation you deserve.

How No Fault Insurance Affects You
Generally speaking, no fault insurance is a type of auto insurance wherein you are not only required to carry insurance for your own protection, but also have a limitation placed on how much you may sue another driver for damages if you are involved in an accident. It is designed as such to cut down on the amount of fraud the state has seen in the past. However, this leads to a lot of ambiguity placed in the system. On the one hand, no fault insurance guarantees that you are covered for immediate medical treatment if you are injured in an accident, as well as to provide quick payment for those injuries. It is also intended to reduce any fees, such as legal or administrative, associated with insurance claims.
On the other hand, you may find that negligent or reckless drivers who have injured you or a loved on are not punished enough due to caps on damage claims. If you are severely injured, the payment may not be enough to cover all expenses. No fault premiums are also more expensive than traditional or standard auto insurance premiums.
Because of the limitations placed on damages, you may find yourself staring at a mountain of financial problems after an accident. In this case, it is important that you know your legal rights. If you or a loved one has been injured in an auto accident, please contact us for an initial consultation. We can help explain further the effects of no fault insurance.
