For the family of 7-year old Jordan Johnson of Lantana, Florida, the worst
possible news came last week following a tragic and fatal wreck involving
a tow truck driver. Based on information publicly available from local
news reports, this terrible crash may be the fault of the tow truck driver.
Why the Johnson family may have a wrongful death case against the driver’s company
Young Jordan was a pedestrian in a residential neighborhood at the time
of the crash, last Wednesday, April 5th, 2017 at about 8:30 p.m., according for Florida Highway Patrol. Reports
indicate that the driver of a tow truck, William Sackett, struck and killed
Jordan in suburban Lantana, on South Broadway and Pine Streets.
Investigators are still working to complete their report. Because a fatality
has resulted in the wreck, the official report may take many weeks to
furnish. In the meantime, the family may be left with my questions unanswered.
Among the most obvious is why.
Pedestrian fatalities often occur for only a few reasons:
- The driver of the vehicle that strikes a pedestrian was distracted
- The driver is under the influence of drugs or alcohol
- The driver was operating at dangerous speeds
- The driver was inattentive of his surroundings
Investigators have not ruled out the possibility that Willian Sackett was
under the influence of alcohol at the time of the crash.
If the report that is eventually released determines that the cause of
the fatal crash was the fault of the driver, the Johnson family could
sue for wrongful death under the laws of Florida.
The defendants of that personal injury lawsuit would likely include the
tow truck company, the owner of the tow truck involved in the crash, the
auto insurer for the company, the liability insurer of the company, or
the auto insurer of the driver.
One of the most important factors that determine whether a
wrongful death case is viable is which party of the crash in question is at fault. In most
instances of pedestrian deaths, it is generally the driver’s fault.
