A security guard is now facing criminal charges after Palm Beach County
Sheriff’s Office deputes say he drove his vehicle into his victim,
battering him, following a physical altercation which took place in the
Pine Glen at Abby Park community in Greenacres.
The man who has been charged, Thomas Kabis, was a security guard for the
community. Police say he approached a resident who was apparently working
on his car in an improper spot on Glencove Way. Kabis reportedly gave
the man a ticket, and then attempted to leave. But the man who received
the ticket was irate, and stood in front of Kabis’ car.
That’s when police say Kabis intentionally drove forward into the
man, causing him to hit the hood and the windshield. Kabis didn’t
slow down; instead, he sped up and attempted a maneuver that would sling
the man off his hood. Medics were called to the scene to tend to the victim
after Kabis called the authorities.
A Potential Personal Injury Case
The potential personal injury case against Thomas Kabis is clear: there
was no need to physically threaten and batter the victim with his vehicle.
The vicim reported physical injuries, as well as a loss in feeling in
his let arm. These injuries could cost thousands of dollars to treat.
Kabis, at 78 years old, is clearly liable. The security company that employs
him may also be held liable in a personal injury lawsuit. If the homeowner’s
association employs Kabis, that HOA may be held liable. Their insurance
company may be required to cover the losses the victim suffered.
And, Kabis may be personally held liable.
Kabis has been charged with aggravated battery, which is a serious crime.
If convicted on that charge, the personal injury civil case against him
could be a stronger one.
