A hit-and-run took place in Palm Beach Gardens last Tuesday evening, where
a pedestrian was fatally struck. The victim was a Massachusetts man that
police identified the following day as Frank M. Vatalaro, 62. Mr. Vatalaro
was attempting to cross Military Trail, just north of PGA Boulevard, where
he was hit by a 2003 Saturn SUV just before 9:00 p.m.
We’ve represented many victims of
hit-and-run crashes that have occurred in this area.
According to police, the 62-year-old victim died that night after he was
taken to St. Mary’s Medical Center in West Palm Beach. The driver
of the vehicle that left the scene was identified as Caleb G. Kent of
Palm Beach Gardens. According to the city police spokesman, Maj. Paul
Rogers, drugs and alcohol are not believed to have played a role in the incident.
Hit-and-run accidents take place in South Florida often, so it is important to know what your rights are as victim or family member
of a deceased person. You have a right to hire an attornrey to represent
your family in a wrongful death claim. It is the job of the personal injury
lawyer to establish liability and damages against Mr. Kent’s auto
insurance company on behalf of the Vatalaro family.
In Wrongful Death cases such as this, it is not the individual defendant
that is legally pursued, but the insurance company. Part of the reason
why we all pay auto insurance is to protect us in incidents such as this.
Damages in this case would include Mr. Vatalaro’s loss of life. What
attorneys like ourselves would pursue from there would be establishing
liability on Mr. Kent for causing the death of Mr. Vatalaro, through examining
police reports, eye-witness testimony, and additional evidence related
to the accident.
Lastly, it is very important to determine what insurance coverage is available
and what the policies include. This is all within the scope of the valuable
work that a personal injury law firm does. Discovering all aspects of
potential insurance policies in existance is our job. In this case, the
existance of a UM (uninsured motorist) policy is crucial in being able
to recover compensation for the loss of live the Vatalaro family has endured.
